Fiance Visa (Prospective Spouse) Weddings

If you’re planning to marry a partner from overseas in a Victoria Marriage Registry Office style ceremony in Australia, you will need to complete and submit a Notice of Intended Marriage form. Once submitted, we will provide you with a confirmation letter for your visa application to the Department of Immigration, confirming the lodgement of your Notice of Intended Marriage. Please note that a non-refundable lodgement fee applies for the Notice of Intended Marriage form. We will also ensure that all necessary legal paperwork is prepared, in accordance with Australian laws, for your marriage once your visa is granted.

If one partner is living overseas and applying for a fiancé (Prospective Spouse) visa to immigrate to Australia, the Department of Immigration and Citizenship requires proof of your intention to marry. Additionally, you must marry within 9 months of arriving in Australia.

It is essential to provide a signed and dated letter (on letterhead) from the authorized marriage celebrant in Australia, who will be conducting the wedding ceremony. This letter should clearly state the date and location of the planned ceremony and confirm that a Notice of Intended Marriage (NOIM) has been lodged with the celebrant.

At the Melbourne Private Marriage Registry, all authorized Commonwealth of Australia marriage celebrants are committed to making this process as simple as possible for you.

The Australian partner (the sponsor) can schedule an appointment with a registered marriage celebrant at the Melbourne Private Marriage Registry to complete the Notice of Intended Marriage form. You will need to bring all relevant documentation, including an original birth certificate if born in Australia or your passport if born abroad, as well as an official copy of any divorce certificate or the death certificate of a late spouse if applicable. Additionally, bring copies of your fiancé’s documents (photocopies or scans are sufficient for the appointment). The celebrant will need to sight the originals of these documents before the legal marriage takes place and prior to signing the Statutory Declaration (Form 14).

Once the paperwork is lodged, you can choose a wedding date, which can be set from one month to up to 18 months after lodging the Notice of Intended Marriage forms. This date will be for a Victorian marriage registry-style wedding at the Melbourne Private Marriage Registry.

Under Australian law, it is required that a Notice of Intended Marriage (NOIM) – ‘Form 13 (Regulation 38)’ be lodged with the celebrant at least one month, and no more than 18 months, prior to the proposed marriage date. If you are planning a Victorian Marriage Registry-style ceremony, you can easily lodge your NOIM at the Melbourne Private Marriage Registry in South Yarra, making it possible for you to legally marry in just one month.

To begin, schedule an appointment with one of the Registered Civil Celebrants at the Melbourne Private Marriage Registry. You can contact us by email or phone during business hours (generally 10am to 7pm, weekdays) to arrange your appointment. During the appointment, you’ll complete the required details on the Notice of Intended Marriage form and submit it to the celebrant. Alternatively, you can send your NOIM ahead of time to start the lodgement process before your appointment.
